Messaging Terms
1. Message programs
Job Space LLC and subscribing organizations (the contractors that use Job Space) may use Job Space to send text messages. Service messages may include account, security, appointment, scheduling, dispatch, job-status, service, support, billing, and transaction updates. Job Space LLC sends service messages under the sign-up consents and, as a separate program, Job Space marketing texts described in section 2 to recipients who opt in to them. A subscribing organization may send its own marketing messages. Marketing messages may include offers, product announcements, or promotions. The opt-in disclosure identifies the sender and message program that apply.
Each message program is subject to the federal Telephone Consumer Protection Act (47 U.S.C. § 227) and applicable FCC regulations (47 CFR § 64.1200), as well as applicable state telemarketing and consumer protection laws, including those of California, Arizona, and Nevada.
It is the subscribing organizations’ (each a “Sender”) responsibility to comply with all applicable federal and state requirements, including obtaining the necessary consent from recipients.
2. Consent
Text-message consent is optional and is not a condition of signing up or of receiving service. Sign-up presents two separate, unchecked consent boxes: one authorizes the contractor (the subscribing organization) named in the box to send service messages to the mobile number provided, and the other authorizes Job Space LLC to send service messages to that number. A recipient may check either, both, or neither. Neither box covers marketing messages. Consent applies only to the sender, number, and message program identified when it is given.
Job Space marketing texts. Job Space LLC sends marketing texts, such as product announcements, offers, and event invitations, only to recipients who check the separate, unchecked text-message box on the Job Space Subscribe for Updates form. Marketing texts are sent through Mailchimp from a number used only for Job Space marketing texts, which is different from the number used for service messages. Each marketing text identifies Job Space and states how to opt out. Consent to marketing texts is not a condition of purchase and does not cover service messages, and the sign-up consents do not cover marketing texts.
A subscribing organization that sends its own marketing texts is responsible for obtaining the recipient’s prior express written consent for them, separately from the sign-up consents. Consent to receive marketing texts is not a condition of purchase.
By opting in, the recipient authorizes the identified sender to deliver messages to the mobile number provided, including through automatic telephone dialing system or artificial or prerecorded voice when stated in the opt-in. The recipient represents that they are the subscriber or customary user of that number and are authorized to provide consent for it.
3. Frequency and charges
Message frequency varies based on account activity, requested services, and the program selected. Message and data rates may apply under the recipient’s wireless plan. Wireless carriers are not responsible for delayed or undelivered messages. Availability may vary by carrier, device, and location.
4. Opt out and get help
- Reply STOP to stop consent-dependent automated texts from the identified sender. Except as provided below for Job Space marketing texts, unless the recipient clearly asks to stop only a particular category, the request applies to all such texts from that sender. We also honor reasonable requests such as QUIT, END, REVOKE, OPT OUT, CANCEL, and UNSUBSCRIBE. All revocation requests must be honored within ten (10) business days of receipt. Sender may not designate an exclusive means of revocation. A called party may revoke consent by any reasonable method, including but not limited to text reply, voicemail, email, or website request.
- Replying STOP to a Job Space marketing text stops Job Space marketing texts. It does not stop service messages, which are a separate program sent from a different number; reply STOP to that number, or use any method in this section, to stop them.
- After an opt-out, the sender may send one non-promotional confirmation and will not send further messages covered by that opt-out unless the recipient provides new consent.
- Reply HELP for help or email support@jobspace.com for assistance.
A recipient may revoke consent through any other reasonable method communicated to the sender. If a recipient has joined more than one message program, the sender may send one message asking which programs the recipient wants to stop; messages requiring consent will pause unless the recipient clearly chooses to continue them.
5. Customer-operated communications
A subscribing organization that selects recipients, content, timing, or purpose for its messages is responsible for the communications it sends. It must have legally sufficient authority and consent, including consent for its own promotional texts, identify itself accurately, send only messages covered by that consent, honor quiet hours and do-not-contact requests, and comply with applicable federal and state law. Job Space may suspend messaging that appears unlawful, abusive, deceptive, or inconsistent with these Terms.
Without limitation, the subscribing organization shall: (a) comply with calling-time restrictions, including the prohibition on telephone solicitations before 8:00 a.m. or after 9:00 p.m. local time at the recipient’s location; (b) scrub recipient lists against the National Do-Not-Call Registry and the subscribing organization’s internal do-not-call list before sending marketing messages; (c) identify the sender clearly in each message; (d) comply with all applicable state telemarketing laws, including the Arizona Telephone Solicitation Act (A.R.S. § 44-1271 et seq.) and the Nevada Deceptive Trade Practices Act provisions on telephone solicitation (NRS 228.500 et seq.); and (e) maintain records sufficient to demonstrate compliance with all consent and opt-out obligations for the period required by applicable law.
6. Number changes and delivery
A recipient must notify the sender or opt out before transferring or discontinuing a mobile number. The recipient is responsible for keeping contact information current. Job Space and the sender do not guarantee message delivery because delivery depends on networks and services outside their control.
7. Privacy and changes
Job Space and its messaging providers and participating carriers may process phone numbers, participant identifiers, message and attachment content, routing and delivery information, and consent, suppression, and opt-out records as described in the Privacy Notice and Subprocessor List. Mobile telephone numbers and text-messaging consent are used only to deliver the messages described in these Messaging Terms; they are not sold and are not shared with third parties or affiliates for their own marketing or promotional purposes. We may update these Messaging Terms by posting the revised version and changing the date above. A material change will not expand an existing marketing consent beyond the sender and program the recipient authorized.
8. Consent and compliance records
The Sender shall maintain records of all consents obtained (including the specific text of the disclosure, the date and time of consent, the medium through which consent was obtained, and the telephone number consented to) and all opt-out and revocation requests received, for a minimum of five (5) years or the period required by applicable law, whichever is longer. Job Space may request evidence of consent from the subscribing organization at any time and may suspend messaging features if the subscribing organization fails to provide satisfactory evidence within a reasonable time.
